Safeguarding Practitioners Amid Changing Legal Landscapes
Following the Dobbs decision in 2022, women's reproductive healthcare practitioners are operating within unprecedented legal and medical environments. TDC Specialty recognizes the uncertainty posed by various state laws impacting this specialized area of medicine. We are pleased to introduce Reproductive Health Defense Protection—coverage in support of healthcare practitioners facing these complex legal landscapes.
This coverage allows reproductive health practitioners to confidently practice within what they believe to be the standard of care by providing a legal defense against civil or criminal allegations.
An endorsement is available for medical practitioners covered under our primary Hospital and Medical Facilities policies. A monoline policy is available for TDC Specialty E&S Physicians and for members of The Doctors Company through a licensed E&S broker.
Eligible risks include:
- Obstetrician-gynecologist (OB-GYN)
- Maternal-fetal medicine specialist
- Certified nurse midwife (CNM), certified midwife (CM), nurse practitioner (NP), physician assistant (PA), family physician
- Genetic counselor
- Emergency room physician
Coverage details:
- Available defense limits range from $100,000 to $500,000 per medical practitioner
- Dedicated defense limit outside of the primary policy limit (for endorsement)
- Separate or combined defense limits are available for accounts where multiple practitioners are scheduled
- No deductible or retention applies
Additional information:
- Defense-only coverage for healthcare practitioners who allegedly violate state criminal or civil law when rendering reproductive care
- Defense for reproductive healthcare decisions to protect the insured against civil allegations, and against criminal allegations until the insured pleads guilty or nolo contendere or is adjudged guilty
- Currently available in 26 states with reproductive healthcare restrictions, including those with criminal or civil consequences
Introducing New EPL Risk Management Services
We recently announced that TDC Specialty now offers primary EPL insureds access to employment practices liability risk management services through TDC Specialty HR Solutions. We are very excited to be able to provide this resource to our EPL insureds. These services include comprehensive informational, educational, and compliance resources accessed through a self-service portal or by direct telephonic access to expert resources.
Some of the many resources include:
- Unlimited HR advice: Real-time advice from certified HR experts supervised by employment attorneys. Provides the perfect sounding board to address HR issues in all 50 states.
- Employee complaint hotline: Promptly address and mitigate the risk of unreported employee concerns by implementing a free employee complaint hotline.
- Training for managers and employees: Implement workforce training with interactive online courses on sexual harassment, discrimination, bullying, hiring, termination, and more.
- Multi-state compliance charts: Compare key HR compliance obligations across the United States in one resource updated regularly by employment attorneys.
Insureds are eligible for this new offering upon binding of their primary EPL coverage on our Healthcare Organizations Management Liability policy form after February 1, 2025. BIPA Coverage Update
Both BIPA and GIPA Acts govern information privacy, and similarly, both Acts do not require proof of actual injury or damages for a violation. We have updated our long-standing BIPA exclusion to include both BIPA and GIPA claims so that our policies will exclude both. Industry experts already associate BIPA and GIPA together, and we believe the updates to the current endorsement provide a benefit in this clarification. With no requirement to prove actual injury or damages, the pricing to cover claims from these Acts would be cost prohibitive. An affirmative exclusion for claims from either Act is the most practical means of addressing this.
